4. IMPORTANT DISCLAIMERS
THE SERVICES PROVIDED BY MENTAL MIKE LLC ARE EDUCATIONAL AND INFORMATIONAL IN NATURE AND ARE NOT INTENDED TO REPLACE PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
Our Services do not constitute medical care, psychiatric treatment, psychological therapy, or counseling. We do not provide medical diagnoses or prescribe medications. No part of this Website is intended to constitute medical or therapeutic advice, and the Content of this Website should not be relied upon when making any decisions or taking any action regarding your health or treatment.
4.2 Coaching vs. Therapy
Recovery coaching and peer support services are distinct from licensed therapy or counseling. Our coaches and facilitators provide support, education, and guidance, but do not engage in the practice of psychotherapy, psychology, or counseling as defined by Iowa law or any other jurisdiction.
4.3 Seek Professional Help
If you are experiencing a medical emergency, psychiatric crisis, or have thoughts of harming yourself or others, please immediately contact emergency services (911), go to your nearest emergency room, or call the National Suicide Prevention Lifeline at 988. Our Services are not designed to address acute mental health crises or medical emergencies.
4.4 No Guarantee of Results
While we strive to provide valuable educational content and support, we make no guarantee of any specific outcomes or results from your participation in our Services. Recovery is a personal journey, and individual results vary based on numerous factors outside our control, including but not limited to your personal commitment, circumstances, and adherence to recommended practices.
5. ELIGIBILITY AND AGE RESTRICTIONS
To use our Services, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction.
- Have the legal capacity to enter into a binding agreement.
- Not be prohibited from using the Services under applicable law.
- Provide accurate and complete registration information.
By using our Services, you represent and warrant that you meet all eligibility requirements. These Terms also apply to business customers procuring Services in the course of business.
6. USER ACCOUNTS AND REGISTRATION

- You have permission to submit Payment Information when permission is required.

- You will maintain the security and confidentiality of your login credentials.
- You accept responsibility for all activities that occur under your Account.
- You will notify us immediately of any unauthorized use of your Account.
7. PAYMENT TERMS
All fees are stated in U.S. dollars and are due at the time of purchase unless otherwise specified. All pricing information on the Website is correct at the time of publication. We reserve the right to change prices and alter or remove any special offers from time to time and as necessary. Changes will not affect purchases that have already been completed. If prices change between the time an order for Services is placed and the time we process the order and take payment, the price valid at the time of the order shall apply.
7.2 Order Confirmation and Contract Formation
Your order constitutes a contractual offer that we may, at our sole discretion, accept. Our acceptance is indicated by our sending you an order confirmation email. Only once we have sent you an order confirmation email will there be a binding contract between Mental Mike LLC and you. Order confirmations will be sent to you before the Services begin and shall contain: confirmation of the Services ordered, including full details of the main characteristics of those Services; fully itemized pricing, including, where appropriate, taxes and other additional charges; relevant times and dates for the provision of the Services; and user credentials and relevant information for accessing those Services. If we, for any reason, do not accept your order, no payment shall be taken under normal circumstances. In any event, any sums paid by you in relation to that order will be refunded within 14 calendar days.
7.3 Payment Methods
We accept payment through the methods indicated on our Website. By providing Payment Information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees. Payment shall be taken via your chosen payment method immediately for any setup fee associated with the service plan you purchased, and on the same day of each subsequent month for subscription services.
7.4 Refund Policy Our refund policy is as follows:
- Course purchases may be refunded within fourteen (14) days of purchase if less than 25% of the course content has been accessed.
- Coaching sessions must be cancelled at least 48 hours in advance for a full refund.
- Subscription services may be cancelled at any time, with access continuing until the end of the current billing period.
- Refund requests should be submitted in writing to admin@mentalmike.org.
We reserve the right to make exceptions to this policy at our sole discretion. Refunds, where applicable, will be issued within 5 working days and in any event no later than 14 calendar days after we confirm your refund request.
8. EU CONSUMER RIGHTS AND COOLING-OFF PERIOD
If you change your mind about the Services within this period and wish to cancel your order, please inform us immediately by email at admin@mentalmike.org.
Suppose the Services are to begin within the 14-day cooling-off period at your express request. In that case, you acknowledge and agree to the following:
- If the Services are entirely performed within the 14-day cooling-off period, you will lose your right to cancel after the Services are complete.
- If you cancel the Services after provision has begun but is not yet complete, you will still be required to pay for the Services supplied up to the point at which you inform us that you wish to cancel, calculated in proportion to the full price of the Services and the actual Services already provided.
Cancellation of Services after the 14-day cooling-off period has elapsed shall be subject to the specific terms governing those Services and our standard refund policy.
9. INTELLECTUAL PROPERTY RIGHTS
All Content included in or made available through our Services, including but not limited to text, graphics, logos, images, audio, video, course materials, the Unified Flux Model framework, and software, is the property of Mental Mike LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. By continuing to use the Website, you acknowledge that applicable United States and international intellectual property laws protect such material.
9.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services and Content for your personal, non-commercial use only. This license does not include the right to:a) Modify, copy, distribute, store, or create derivative works from our Content.b) Use our Content for commercial purposes without written authorization.c) Download, record, or capture video or audio content except where expressly permitted.d) Share, resell, or redistribute course materials or login credentials.e) Remove any copyright, trademark, or other proprietary notices.

Unless otherwise expressly indicated, all intellectual property rights, including but not limited to, copyright and trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable. You may not reproduce, copy, distribute, store, or in any other fashion reuse such material unless otherwise indicated on the Website or unless given express written permission to do so by the relevant manufacturer or supplier.
9.4 Trademarks
"Mental Mike," "Mental Mike LLC," "Unified Flux Model," and any associated logos, designs, and slogans are trademarks or service marks of Mental Mike LLC. You may not use these marks without our prior written permission.
10. USE OF COMMUNICATIONS FACILITIES AND USER CONDUCT
- You must not use obscene or vulgar language.
- You must not submit Content that is unlawful or otherwise objectionable, including but not limited to Content that is abusive, threatening, harassing, defamatory, ageist, sexist, or racist.
- You must not submit Content that is intended to promote or incite violence.

If Services are provided that are not in conformity with your order and are thus incorrect, you should contact us immediately to inform us of the mistake. We will ensure that any necessary corrections are made within five (5) working days.

19.5 Force Majeure
Mental Mike LLC shall not be liable for any failure or delay in performing obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or internet service failures.
19.6 Third Party Rights
Nothing in these Terms shall confer any rights upon any third party. The agreement created by these Terms is between you and Mental Mike LLC.
19.7 Communications and Notices
All notices and communications shall be given to us either by post to our Premises (P.O. Box 106, Audubon, Iowa 50025) or by email to admin@mentalmike.org. Such notice will be deemed received 3 days after posting if sent by first-class post, the day of sending if the email is received in full on a business day, and on the next business day if the email is sent on a weekend or public holiday.

21. ACKNOWLEDGMENT
BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU ALSO ACKNOWLEDGE THAT THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND MENTAL MIKE LLC.
Your agreement to comply with and be bound by these Terms is deemed to occur upon your first use of the Website. If you do not agree to be bound by these Terms, you should stop using the Website and Services immediately.
